CPRB Rules Against Dangerous Cop

March 31st, 2006 Pittsburgh Police Officer Eugene Hlavac endangered
the safety of all of the bicyclists riding in Critical Mass by aggressively
and offensively driving his squad car through a slow moving group of
cyclists, and then threatened, cursed at, and refused to give his badge
number to anyone else in that group.

WQED (Pittsburgh's PBS station) recorded all of this. Here's a youtube link.

After witnessing a police officer endangering instead of protecting,
cursing at, threatening arrest for no reason, and generally abusing his
power, I used what little recourse is available to me by filling a
complaint with the Citizen Police Review Board.

After two years, the CPRB gathered it's evidence, took statements from
many witnesses, and proceeded to public hearing against Officer Hlavac.

On January 24th 2008, Officer Hlavac came to that hearing. He
wore his iPod headphones throughout, playing them loud enough that
everyone present in the City Council Chambers would be sure to know his
contempt for the proceedings. When called, his FOP lawyer had to go to the
bench where his was sitting and physically tap him on the shoulder to
get his attention. On the record, he refused to answer any question the
board asked him.

Because, he said, his answers would incriminate him.

Please think about that for a moment. When a Pittsburgh Police Officer
was asked to describe his actions, while ostensibly on duty, he refused
to answer because he feared that describing his on-duty actions could
potentially lead to criminal charges against him.

The CPRB, when reviewing video evidence of his actions, and upon hearing
witness after witness describe the officer drive his car into a
slow-moving group of cyclists, sustained the charges against the
officer.

Beyond that, beyond even noting that they found the actions to
be a "very serious act of misconduct," the CPRB went on to recommend
that the Chief or Mayor refer the matter to the district attorney for
possible criminal prosecution.

The Chief response: "I reject your recommendations regarding discipline."

To me, this sends a clear message. The Mayor (who has the power to accept or reject the recommendations of the CPRB) and Chief Harper are sending a clear message: that they care so little for the safety of cyclists on City streets that they will take no action against one of their own employees who, in a fit of rage, drove his Pittsburgh Police car at a group of cyclists.

That this is the police force that is supposed to protect cyclists from dangerous and aggressive drivers truly frightens me.

At this point, I have tried everything that I can think of to hold this officer accountable: I contacted City Council members, who have shrugged; the Office of Municipal Investigation, who assigned Officer Hlavac "anger management" again, (he's also one of the promoted officers with a history of domestic violence); and I worked with the CPRB for two years while they conducted an exhaustive investigation.

And this is the result: an independent investigation that finds "very serious acts of misconduct" and recommends that the District Attorney look into filing criminal charges against the officer, yet leads to absolutely no action whatsoever against that officer.

If anyone has any idea as to how to actually hold this officer accountable for his actions and his obvious contempt for those he is sworn to protect, please, let's hear them.

an editorial in the paper, contacting the local media, pittsburgh indymedia... couldn't hurt...did the mayor say he wouldn't address this? maybe someone from thomas merton can help? just throwing around ideas.
It would be a shame if the CPRB's recommendations were just brushed aside...kind of a pointless board if they are just there for show.

what was going on at the city county building around 4 o'clock on thursday? may 1st. i rode down grant and saw a bunch of kids, bikes, and i could hear a girl raising a ruckus with a bullhorn. looked like a protest. anything to do with this?

this post saddens me. but good job morgan for being so vigilant about it.

i have avoided critical mass since one april several years ago when someone was arrested. our request for bike cops was denied. i find critical mass to be a waste of my time... i know people are die hard about it, but i would like to think that there is another way to demonstrate ourselves publicly to the city...

How about contacting the US Attorney's office? They seem to like going after local politicians with a D after their name, and the officer is probably a Democrat since A) he is a member of a union; and B) he appears to be protected by the political establishment of the city, which is old school Democrat. Not that I approve of what the US Attorney seems to be doing, but if the local authorities refuse to enforce the law in the face of overwhelming evidence ...

I don't know any lawyers, but maybe you could get the ACLU interested. Did you try passing it on the local news stations where they have the guy that tracks down busses that go through red lights and meter readers who park illegally. I have to think someone would bite on this.

You don't have to be on a bike for cops to treat you like poo. Too many cops become cops so that they have power to do as they please. There are naturally many good cops out there, but you do not hear about them because they do not do stupid stuff.

Some cops are basically nothing more than barfly tough guys with a piece of tin pinned to their chests. They do stupid stuff then probably meet up with their buddies at the bar and joke about it.

Much like with bikers, it is these "bad" examples that you hear about most often. You never hear stories about the good bike riders that actually follow the rules, you hear about the idiots. You neve hear about the good cops that do a good job, you hear about the idiots.

(I am not a cop supporter or anything like that, just my opinion)

i don't know, i feel like it's impossible to not hear of the "good cops" here. i mean Police Departments have a huge PR dept. anyone who grew up in the states and went to elementary school here and had to sit thru countless "officer friendly" assemblies, watched "Cops" on tv, or read articles about all the "good deeds" these guys do is aware of the power and reach of their PR machine. aside from the profession of executioner, in what other way can you straight up murder someone, be found innocent, and still get praised for "just doing your job."

i think it's silly to compare the two, but just think if we went thru assemblies in school on safe cycling practices, sharing the road, and all the cool things you can do with bikes, then go home and watch a tv show (ie. recruitment tool) called "Bikers" where it shows an edited down version of what it's like to be a cyclist and all the good deeds and bad drivers that you have to deal with, and take care of on a daily basis.

even if that were the reality, i would think most people would have a better opinion of cyclists, and still tense up and get nervous when they see a cop.
